By entering the Isuzu UTE Talking Footy Competition (“the Competition”) you are agreeing to the following terms and conditions:

 

1.            STANDARD TERMS

1.1          Information on how to enter forms part of the terms of entry.

 

2.            WHO CAN ENTER

2.1         Subject to clause 2.2, entry is open to all residents of Australia 18 years of age or older in Australia where the Channel Seven and its affiliated networks (“Affiliates”) signals are received.

2.2         Employees and their immediate families of Seven Network (Operations) Limited (“the Promoter”), Isuzu UTE Australia Pty Ltd (“Prize Sponsor”) including their associated agencies and companies are not eligible to enter, nor participate in the prize.

 

3.            HOW TO ENTER

3.1         The Competition commences Monday 13th May 2019 at 19.30 (AEST) and concludes on Wednesday 11th September 2019 at 24:00 (AEST) (“the Competition Period”).

3.2         For entry details, viewers must watch the Talking Footy telecast that airs the competition spot on the Seven Network and Affiliates during the Competition Period. The competition spot will display information on how to enter.

3.3          In order to enter the draw, viewers must:

Visit the competition page at http://www.winwithtalkingfooty.com.au and tell us in 25 words or less who was your player of the week and why. Entrants must also select their preferred prize of either a Isuzu D-MAX or Isuzu MU-X (‘Major Prize”) and enter in their first name, last name, gender, D.O.B, mailing address, suburb, state, postcode, mobile, and e-mail address, and select to ”opt in”. 3.4         Entries must be received within the Competition Period. The time of entry will in each case be the time the online submission is received by Seven Network Operations Limited.

3.5         Entrants (including winners) in the Competition may enter as many times as they like but each entry must be unique and:

               (a)           be the original independent creation of the entrant; and

               (b)          be free from any claims, including copyright or trademark claims, by other parties. 

3.6          Entry details remain the property of the Promoter and will not be returned to the entrant.  Entrants agree to grant the Promoter a perpetual and non-exclusive licence to use, distribute, broadcast and sub-licence their entries in all media worldwide and acknowledge that they will not be entitled to any fee for such use.

4.3   Major Prize Details cannot be changed (including, but not limited to, model, transmission, colour etc.), and Major Prize must be accepted as stated above.

4.4   Promoter and Prize Sponsor makes no representation as to the safety, conditions or other issues that may exist with either vehicle.

4.5   Compliance with any health or other government requirements in relation to the vehicle is the responsibility of the Major Prize Winner.

4.6   Major Prize values are in Australian dollars ($AUD).

4.7   Both the Promoter and Prize Sponsor accept no responsibility for any variation in the Major Prize values.

4.8   The Major Prize is non-transferrable. The Major Prize must be taken as stated and no compensation will be payable if the winner is unable to use the prize as stated. The Prize is not exchangeable or redeemable for cash or other goods or services. Any unused portion of the prize is not redeemable for cash.

4.9   Major Prize cannot be used in conjunction with any other special offer.

4.10It is a condition of accepting the prize that the winner accepts the conditions of use of that prize.

4.11 The Promoter reserves the right to any remedy, including withdrawal, denial or cancellation of a prize, if fraud, tampering or other violations of this Competition terms and conditions are suspected.

4.12 In the event that an element of either prize outlined above (cl. 4.2) is for any reason not available, that element(s) of the prize will be considered as forfeited and no cash alternative offer will be granted in lieu of the part of the prize. 

4.13 Unless expressly stated in these terms and conditions all other expenses related to the prize become the responsibility of the Major Prize Winner. This includes, but is not limited to, travel to and from appointed Isuzu UTE Australia dealer, additional options/accessories added onto the Prize, any ancillary costs associated with collecting the Major Prize, as well as any ongoing costs associated with the Major Prize.

4.14 The Promoter and Prize Sponsor take no responsibility for fuel, comprehensive vehicle insurance, health, transport, body, paint or mechanical damage, or any other costs or damages, from the date of Major Prize delivery.

4.15 Once the prize is accepted, the Major Prize Winner must deal directly with the Prize Sponsor should there be any specific requests, queries, concerns or complications.

4.16 The Major Prize will be available for collection at an appointed Isuzu UTE Australia dealer from a major capital city within Australia, within 28 days of the Major Prize Winner being determined, or such other time as agreed in writing between the Major Prize Winner, the Promoter and the Prize Sponsor, in the event there are issues with vehicle stock availability.

4.17 The Winner is advised that independent financial advice should be sought, as tax implications may arise as a result of accepting the prize.

4.19 Subject to state permit authority restrictions, the Promoter may amend these terms and conditions in its absolute discretion.

4.20 In accepting the prize, the Major Prize Winner agrees to participate in and co-operate with all reasonable media editorial requests, including but not limited to being chaperoned, interviewed, photographed and filmed. The Major Prize Winner grants the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winners will not be entitled to any fee for such use.

4.21 The Major Prize Winner agrees they will not sell or otherwise provide their story and/or photographs to any media or other organisation.

4.22 It is a condition of accepting the Major Prize that the Major Prize Winner must comply with all the conditions of use of the prize and the Prize Sponsor’s requirements. Should the Major Prize Winner not meet any of the criteria stated in these Terms and Conditions to be a valid Winner they will forfeit all rights to the Major Prize, and a redraw will take place to reallocate the Major Prize to a valid Winner.

4.23The Major Prize Winner must be 18 years of age or older and must provide valid identification to the Promoter.

4.24 If the Major Prize Winner does not hold a current Australian Driver’s Licence, the Major Prize can be awarded to an adult nominated by the Major Prize Winner, who holds an Australian Driver’s Licence, on behalf of the Major Prize Winner. The Major Prize Winner may be required to sign a Major Prize transfer or legal release to formalise the transfer. Alternatively, if the Major Prize Winner does not hold a current, open, unrestricted licence, they must arrange for the Major Prize to be transported to their residence. Any costs associated with transporting the Major Prize from the delivering dealership are the sole responsibility of the Major Prize Winner, and both the Promoter and the Prize Sponsor accepts no responsibility for these costs. If the Major Prize Winner does not provide proof of meeting the age restriction and other valid Entry requirements, the Major Prize will be forfeited in full, and the Winner will have no further claim. A re-draw will be held to award the Major Prize to a valid entrant

5.            HOW TO WIN

5.1         There will be one (1) Major Prize Winner judged from the national pool of online entrants who will win either Prize Package 1 or Prize Package 2, as detailed in clause 4.2. There will be one (1) reserve Major Prize Winner judged at the same time, to be contacted in the event the original Major Prize Winner does not claim the prize. Each entrant who has entered the Competition in accordance with these terms and conditions during the Competition Period will be considered.  Entries that do not comply with these terms and conditions, may be deemed invalid. All entries will be judged by a judge appointed by the Promoter in its absolute discretion at the offices of Seven Network Operations Limited, Media City - 8 Central Avenue, Eveleigh NSW 2015 Australia on Wednesday 12th September 2019 at 10:00AM (AEST). The entrant(s) whose entry is judged as the most creative entryout of all entries received will be deemed the winner. The Competition is a game of skill, and chance plays no part in determining the winner.

5.2         The Major Prize Winner will be notified by a phone call following the judging, and should the Winner respond immediately, a letter confirming the Winner of their prize will also be posted or emailed.

5.3       The Major Prize Winner will have 48 hours from the first notification attempt being made to respond and accept the prize. Should the Major Prize Winner not respond to the initial notification phone call, an additional 4 phone calls will be made (2 being outside the hours of 9.00 am AEST to 5.00 pm AEST), and a letter advising them they are the Winner will be express posted to their postal address. In addition, 2 emails will be sent to the email address used to enter the competition 24 hours apart. The emails and letter will instruct the Winner to respond within 48 hours to accept their prize before the Prize goes to the reserve Winner, and detailed instructions on how to respond and accept.  Once the Winner is reached and notified, they will be required to complete a prize acceptance form that includes liability and publicity waivers and provide a copy of their official photo ID to formally accept the prize.

5.4         In the event that the original Major Prize Winner does not meet the above prize acceptance deadline or cannot be contacted, the next reserve Winner judged will be notified and will have 48 hours to accept the prize and complete the Major Prize acceptance paperwork.

5.5         The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the result.

5.6         In addition to the Waivers mentioned in cl 5.3, it is a condition of accepting the prize that the winner may be required to sign an additional legal release in a form determined by the Promoter in its absolute discretion.

5.7         The Promoter may in its absolute discretion deem entries invalid subsequently to a winner being notified or a winner’s name being announced if it is discovered that the winner did not enter the Competition in accordance with these terms and conditions. In these circumstances, an additional draw will be conducted.

 

6.            NO LIABILITY

6.1             In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions, subject to state government legislation.

6.1             The Promoter and the Prize Sponsor accepts no responsibility for the condition of the Major Prize Vehicle once dispatched to the Major Prize Winner. The Major Prize Vehicle comes with Compulsory Third Party Insurance only and the Winner of the Major Prize Vehicle will be responsible for obtaining any additional insurance at their own cost.

6.2         The Promoter, Prize Sponsor and their associated agencies and companies will take no responsibility for prizes damaged or lost in transit, or late, lost or misdirected.

6.3         The Promoter, Prize Sponsor and their associated agencies and companies will not be liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:

a)    during the draw;

b)    in the acceptance, participation or use of any element(s) of the prize;

c)     as a consequence of late, lost or misdirected mail;

d)    due to the broadcast of any program relating to the Competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;

e)    in relation to failure of an online entry to be received by the Promoter on account of technical problems or traffic congestion; or

f)     arising from or related to any problem or technical malfunction of any communications network related to or resulting from participation in this promotion.

6.4         The Promoter and Prize Sponsor shall not be responsible for, and excludes all liability for, any personal injury, loss or damage whatsoever, arising out of the use of the prize.

6.5         The Promoter and Prize Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of entries, and reserves the right to take any action that may be available, subject to state government legislation.

6.6         If for any reason the Competition is not capable of running as planned, due to causes including but not limited to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of the Competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, take any action that may be available, and to cancel, terminate, modify or suspend the Competition, subject to state government legislation.

6.7         By entering the competition, and by collecting a prize, the winner acknowledges and accepts that driving, travel and any other activities comprising the prize, are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. Neither the Promoter nor the Prize Sponsor are responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may occur whilst the winner is travelling.

6.8         Nothing in these Terms and Conditions limit, exclude or modify or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) and Prize Sponsor excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the competition.

6.9         Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and the Prize Sponsor (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; or (f) use of a prize.

 

7.            Provision and Use of Entrant List - Privacy Undertaking by Isuzu UTE Australia Pty Ltd: Isuzu UTE Talking Footy Competition

 

7.1          The Entrant acknowledges that the Promoter will be providing the Prize Sponsor with the Isuzu UTE Talking Footy Competition entrant list of all entrants to receive Isuzu UTE marketing material after the date and time of publication of the Privacy Statement on the entry page (and consisting of name and email address of all entrants) within 14 days of the end of the competition.

 

7.2.0         The Entrant agrees to the Promoter providing the Prize Sponsor with the Entrant’s first name, last name, gender, D.O.B, address, suburb, state, post code, mobile, and e-mail address.

 

7.3          Isuzu UTE Australia Pty Ltd:

 

a.      agrees that it may use the entrant list in perpetuity for the purposes set out in the Isuzu UTE Australia Pty Ltd Privacy Statement( As stated in cl 7.1); and

 

b.      acknowledges it will handle any personal information of the competition entrants that is disclosed to the Prize Sponsor (such as that listed in cl 7.2) in accordance with the Spam Act (Cth) and Privacy Act 1988 (Cth) including the Australian Privacy Principles.

 

7.4.1         The Promoter and its related bodies corporate are indemnified with respect to any claim or loss arising out of the Prize Sponsor’s failure to comply with the obligations listed above.
