Macca’s Kick 2 Kick Competition
Terms and Conditions
By entering the Macca’s Kick 2 Kick competition (“the Competition”), the entrant agrees to the following terms and conditions:
1. STANDARD TERMS
1.1 Information on how to enter forms part of the terms of entry.
2. WHO CAN ENTER?
2.1 Subject to clause 2.2, entry is open to all residents 18 years of age and older in Australia where the Channel Seven signal is received. Parents/Guardians of persons under 18 years of age may enter on behalf of persons under 18 years of age by accepting these Terms and Conditions.
2.2 Employees and their immediate families of Seven Network (Operations) Limited, Ansible Pty Ltd and McDonald’s Australia Limited and their associated agencies and companies are not eligible to enter.
3. HOW TO ENTER
3.1 The Competition commences on 12.01am (AEST) Friday 2 February 2018 and concludes on 11.59pm (AEST) Sunday 26 August 2018 (“the Competition Period”).
3.2 Entrants must enter via EITHER Facebook or Instagram or Twitter as outlined below:
a) Facebook Entry: upload to their Facebook page a Kick 2 Kick photo with the hashtag #maccask2k and a creative caption for the photo; OR
b) Twitter Entry: send a ‘tweet’ from their Twitter account including a Kick 2 Kick photo and the hashtag #maccask2k and a creative caption for the photo; OR
c) Instagram Entry: upload to their Instagram account a Kick 2 Kick photo and the hashtag #maccask2k and a creative caption for the photo; OR
d) Direct Upload: upload their image to 7AFL Facebook competition tab (http://ngx.me/2r5ba0q) or via the website www.maccask2k.com.au (which is a vanity URL that redirects to the 7AFL Facebook competition tab).
e) Entrants who enter via Facebook, Twitter or Instagram must ensure their Facebook/Twitter/Instagram account used for entry is not set to ‘private’.
3.3 Entries must be received within the Competition Period.
3.5 Entrants (including winners) in the Competition may enter as many times as they like but each entry must be unique and:
(a) the original independent creation of the entrant; and
(b) free from any claims, including copyright or trademark claims, by other parties.
(c) must have the permission of any individual depicted (and be their parent/guardian in the case of any child)
3.6 Entry details remain the property of the Promoter and will not be returned to the entrant. Entrants agree to grant the Promoter a perpetual and non-exclusive licence to use, distribute, broadcast and sub-licence their entries in all media worldwide and acknowledge that they will not be entitled to any fee for such use.
3.7 Any cost associated with accessing the promotional websites is the entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid.
3.8 This competition is a game of skill and chance plays no part in determining the winner.
4.1 There will be five (5) major prize winners and five (5) minor prize winners who will receive the prize package detailed in clause 4.2.

2 x admission tickets to attend the 2018 Toyota AFL Grand Final on September 29, 2018, to take part in a kick with AFL Legends, inclusive of return economy airfares (excluding Victorian winner) from their closest capital city to Melbourne, Victoria and 2 night’s twin share four star accommodation on the 28th and 29th of September.
MAJOR PRIZE VALUE TOTAL PRIZE VALUE
(1) kicking event with an AFL legend in their closet capital city, valued up to AUD$500 (including GST) each.
Date, time and venues to be confirmed with the prize winners closer to the event.

Total maximum value for major and minor prize package(s) is up to AUD$37,500.00 (inclusive of GST).Prize value is correct as at the date of printing. The Promoter accepts no responsibility for change in prize value between now and the ultimate date on which the prize is taken.
4.3 In the event that an element of a travel, event, concert or other similar prize outlined above is, for any reason, cancelled, postponed or not available, that element(s) of the prize will be considered as forfeited and no cash alternative offer will be granted in lieu of the part of the prize.
4.4 Unless expressly stated in these terms and conditions all other expenses become the responsibility of the major prize winner and (where applicable) their companion, including but not limited to all meals, all ground transfers, spending money, incidentals, mini-bar, laundry, room service, telephone calls and all other ancillary costs. A credit card imprint may be required by hotel or other accommodation providers for incidentals (which are not included in the prize unless otherwise expressly set out in clause 4.2 above)
4.5 Minor Prize winners will be required to make their own way to the kicking event. Minor Prize winners are responsible for all costs associated with accepting and participating in their prize. In the event that a Minor Prize Winner is unable to travel to the nominated kicking event location, the prize will be forfeited.
4.6 Once the prize is accepted, the prize winner must deal directly with the prize supplier should there be any specific requests, queries, concerns or complications.
4.7 In accepting the prize the winners agree to participate in and co-operate with all reasonable media editorial requests, including but not limited to, being interviewed and photographed, and the winners grant the Promoter a perpetual and non-exclusive licence to use such footage and photographs in all media worldwide and the winners will not be entitled to any fee for such use.
4.8 The winners agree they will not sell or otherwise provide their story and/or photographs to any media or other organisation.
4.9 It is a condition of accepting the prize that the winner’s must comply with all the conditions of use of the prize and Sponsor’s requirements.
4.10 This promotion is in no way sponsored, endorsed or administered by, or associated with Facebook, Instagram or Twitter. Any questions, comments or complaints about this promotion must be directed to the Promoter and not to Facebook, Instagram or Twitter. Facebook, Instagram or Twitter will not be liable for any loss or damage or personal injury which is suffered or sustained by an entrant, as a result of participating in the promotion (including taking/use of a prize), except for any liability which cannot be excluded by law.
4.11 Prizes cannot be redeemed for cash and are not transferable or exchangeable.
4.12 Independent financial advice should be sought as tax implications may arise as a result of accepting the prize.

4.14 Subject to state permit authority restrictions, the Promoter may amend these terms and conditions in its absolute discretion.
- 5. WARRANTIES
5.1 Entrants agree that they are fully responsible for any materials they submit via the Competition including but not limited to comments, videos and photographs (“Content”). The Promoter shall not be liable in any way for such Content to the full extent permitted by law. Entrants warrant and agree that:
- i. they will not submit any Content that is unlawful or fraudulent, or in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene, derogatory, pornographic, sexually inappropriate, violent, abusive, harassing, threatening, objectionable with respect to race, religion, origin or gender, not suitable for children aged under 15, or otherwise unsuitable for publication;
- ii. their Content shall not contain viruses or cause injury or harm to any person or entity;
- iii. they will obtain prior consent from any person or from the owner(s) of any property that appears in their Content;
- iv. they are the parent or legal guardian of any child and/or children appearing in any Content and give consent to the use of the Content for the purposes described in these terms and conditions;
- v. they are the owner of copyright in the Content, or they have obtained full prior consent from any person who has jointly created or has any rights in the Content, and the Content does not infringe the rights of any third party;
- vi. they consent to any use of the Content which may otherwise infringe the Content creator’s/creators’ moral rights pursuant to the Copyright Act 1968 (Cth) and warrant that they have the full authority to grant these rights; and
- vii. they will comply with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and the access or use of others' computer or communication systems.
5.2 Entrants acknowledge that the public will have the capacity to comment on the Content, and will not hold the Promoter or Sponsor liable for the publication of any comments, whether derogatory, offensive, racist, defamatory or otherwise, posted in relation to the Content.
6. HOW TO WIN
6.1 There will be five (5) major and five (5) minor prize winner(s). All entries will be judged by a panel of judges appointed by the Promoter in its absolute discretion at the offices of Level 2, 38-42 Pirrama Road, Pyrmont, NSW 2009 by 29/08/2018. Winners may be drawn at times during the Competition Period. The entrants whose entries are deemed to be the most creative entries out of entries received at that point in the Competition Period will be deemed either a major or minor Prize Winner as determined by the Promoter. .The Competition is a game of skill and chance plays no part in determining the winner.
6.2 The major prize winner(s) will be notified by a phone call or email from the Promoter on the day of judging, or will be contacted via the Promoter commenting on their social media pages with a request for a private message to exchange contact details.
6.3 Entrants in the Competition may enter as many times as they like. A single Entrant may submit multiple entries and win both a Minor Prize and Major Prize.
6.4 The judges’ decision (including any decisions as to prize distribution) is final and the Sponsor/ Promoter will not enter into correspondence regarding the result. The Promoter may in its absolute discretion deem entries invalid subsequently to a winner being notified or a winner’s name being announced if it is discovered that the winner did not enter the Competition in accordance with these terms and conditions. In these circumstances, an additional judging will be conducted.
6.5 It is a condition of accepting the prize that the major prize winner(s) (and their companions) agrees to comply with all the conditions of use of the prize and prize supplier’s requirements.
6.6 It is a condition of accepting the prize that the major prize winner (and their companions) may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
7. NO LIABILITY
7.1In the case of the intervention of any outside act, agent or event which prevents or significantly hinders the Promoter’s ability to proceed with the Competition on the dates and in the manner described in these terms and conditions, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may in its absolute discretion cancel the Competition and recommence it from the start on the same conditions.
7.2 Seven Network (Operations) Ltd, and its associated agencies and companies will take no responsibility for defective prizes or prizes damaged or lost in transit, or late, lost or misdirected mail.
7.3 Seven Network (Operations) Ltd, and its associated agencies and companies will not be liable for any claims, misadventure, accident, injury, loss (including but not limited to consequential loss) or claim that may occur:
a) during entry into the competition
b) during the judging;
c) whilst undertaking any travel won on or connected with their entry into the Competition; or
d) in accepting of or participating in the prize;
e) as a consequence of late, lost or misdirected mail;
f) due to the broadcast or publication of any program relating to the Competition or the publication of any material, including any statements made by any compere, staff member, journalist, other entrants or any other person;
g) in relation to failure of an entry to be received by the Promoter on account of technical problems, website or phone anomalies, or traffic congestion; or
h) in relation to the entrant or any other person's computer software, computer equipment or internet connection resulting from or related to participation in this Promotion;
i) any variation in Prize value to that stated in these Terms and Conditions that is not due to an intentional error by Seven and/or its agencies and affiliates;
j) any technical difficulties, technical error or equipment malfunction (whether or not under the Promoter’s control);
k) any error, omission, interruption, deletion, delay, defect, theft, unauthorised access or third party interference; or
l) due to any change in these terms and conditions or any change in Seven’s programming, scheduling or production of broadcast material
7.4The Promoter reserves the right to reasonably amend or vary these terms and conditions at its sole discretion, orally or in writing, for the purpose of Seven’s programming, scheduling or production requirements.
7.5 By entering the competition, and by participating in a prize, the prize winner acknowledges and accepts that driving, travel and any other activities comprising the prize, are inherently dangerous and may result in death, injury, incapacity, damage to property or other losses. Neither the Promoter is not responsible for any acts of god, such as adverse weather conditions or industrial action or civil commotion that may occur whilst the prize winner is travelling. It is the responsibility of the prize-winner to enquire about local issues and conditions at destinations prior to travel.
8 PROMOTER’S DETAILS
8.1 The Promoter is Seven Network (Operations) Limited (ABN 65 052 845 262) of Level 2, 38-42 Pirrama Road, Pyrmont, NSW 2009.
8.2 The Sponsor is McDonald’s Australia Limited (ABN 43 008 496 928) of 21 – 29 Central Avenue, Thornleigh, New South Wales 2120
8.3 Entry details remain the property of the Promoter.
8.5 The Promoter will consider all eligible entries received during the Competition Period, including those received at the start of the Competition Period when the Sponsor was the Promoter of the Competition.
