TERMS AND CONDITIONS for “ABSOLUTE RADIO – WIN £10,000 MADE UP OF WICKES GIFT CARDS AND CASH (50:50 SPLIT) WITH THE DAVE BERRY BREAKFAST SHOW, TOWARDS A COMMUNITY PROJECT” (the “Competition”).
These terms and conditions (the “Specific Terms”) for the Competition should be read alongside our general competition terms and conditions at: http://www.bauerlegal.co.uk/radio-competition-terms.html (the “General Terms”) which will also apply to this Competition. Where there is any conflict between these Specific Terms and the General Terms, the Specific Terms shall prevail.
1.ENTRY ROUTES AND COSTS
Entries are restricted to one (1) per person (“Entrant”).
Entry to the Competition is available via the following routes:

2.COMPETITION MECHANIC AND HOW TO WIN
There will be one (1) winner of this competition. Four (4) entries will be shortlisted in total and the final winner will be selected from there.
To be eligible to win, entrants must go online to absoluteradio.co.uk and tell us the below details. Failure to comply with any of these bullet points may result in an invalidated entry and the breakfast team will need to shortlist another entry:
· Full name
· Contact details[JH1] (phone number and email address)
· Provide a short script for a radio advert to promote the community project they would like to nominate to receive the prize.
o Eligible community projects looking for a Wickes Improvement project include:
§ Sports clubs;
§ Registered Charities as found on https://www.gov.uk/find-charity-information;
§ Community Amateur Sports Clubs (“CASC”) as registered on the HMRC website: https://www.gov.uk/government/publications/community-amateur-sports-clubs-casc-registered-with-hmrc--2;
§ Community Interest Companies;
§ Local businesses as registered on Companies House: https://www.gov.uk/get-information-about-a-company where the business can demonstrate it is positively impacting the community with their individual project;
§ Community spaces;
§ Garden centre nurseries;[JH2]
§ Youth groups (18+ organisations only);
§ Recreational Groups, including adult sports organisations;
§ Hospices and hospitals;
§ And, animal wildlife rescue organisations.
o Exclusions:
§ We’re sorry to not be able to include schools, colleges or any group operating with under 18-year-olds.
· You will need to be available during the days as listed below [JH3] and able to send audio notes to the producers of The Dave Berry Breakfast Show.
Shortlisting:
There will be four (4) rounds of the competition where entries will be shortlisted through a judging process in the following way:
· Ten (10) entries for each round will first be shortlisted at random by electronic selection, each taking place on the below-listed dates.
· Entries will then be judged by how entertaining, compelling, heart-warming and deserving the entry and advert script is.
· A shortlist of three (3) entries will then be passed to the Dave Berry Breakfast Show production team, the production manager and an independent judge to further shortlist.
Shortlisting will start from 11:00 AM on Thursday 10 October 2024 and will finish at 11:00 AM on Tuesday 15 October2024. Each round date and time are listed below:
· Round 01 - shortlisting will take place at 11:00 AM on Thursday 10 October 2024 for entries into the show taking place on Monday 14 October 2024. All eligible entries up to this time and date will be considered. Please note, the production team may need you available to send the audio to them on Friday 11 October 2024.
· Round 02 - shortlisting will take place at 11:00 AM on Friday 11 October 2024 for entries into the show taking place on Tuesday 15 October 2024. All eligible entries up to this time and date will be considered. Please note, the production team may need you available to send the audio to them on Monday 14 October 2024.
· Round 03 - shortlisting will take place at 11:00 AM on Monday 14 October 2024 for entries into the show taking place on Wednesday 16 October 2024. All eligible entries up to this time and date will be considered. Please note, the production team may need you available to send the audio to them on Tuesday 15 October 2024.
· Round 04 - shortlisting will take place after 11:00 AM on Tuesday 15 October 2024 for entries into the show taking place on Thursday 17 October 2024. All eligible entries up to this time and date will be considered. Please note, the production team may need you available to send the audio to them on Wednesday 16 October 2024.
On shortlisting, we will require the nominator to coherently explain their entry and discuss their nomination. The entry must be compelling and match the entry that was entered online. Being called during the entry period does not mean that the entrant has been successful in making it through the shortlisting process.
If the entrant is successful through the shortlisting process, they will be brought to air as a finalist* during the Absolute Radio Dave Berry Breakfast show between 06:00 AM to 10:00 AM from 14/10/2024- 18/10/2024.
All nominators will be called ahead of the competition segment being recorded or before being brought to air. If the chosen finalist is unavailable when the production team calls them, a backup finalist will be chosen in their place and the original finalist may miss out on winning.
Finalists:
Once selected as a finalist by the Absolute Radio production team, the entrant will be invited to play the on-air part of the competition. There will be one (1) finalist each day from 14/10/24 –17/10/24.
One entrant will play each morning between the times of 06:00 AM – 10:00 AM with the grand final taking place between 06:00 AM – 10:00 AM on 18/10/24.
Each day from 14/10/24 until 17/10/24 the final round will be played live/ or as live if pre-recorded on-air during the Absolute Radio Breakfast show.
The grand final will take place on 18/10/24. One (1) winner will be selected from the four (4) finalists and awarded the prize on-air.
The Winner:
Please note, that on 18th October 2024[JH4] , the winner will be announced live on-air. Following the winner’s announcement, a special presentation from the Absolute Radio production team may take place thereafter. A presenter/ friend of Absolute Radio and Wickes will visit the winner at their chosen address. A videographer may be in attendance and the visit will be filmed. The winner and any supporting friends/ family included in the footage will be asked to sign a release form to allow the footage to be used on Absolute Radio & Wickes social and online channels.
The Absolute Radio Team reserve the right to pre-record any part of this competition with contestants before the 'as-live' broadcast.
Entering online does not guarantee you will be invited to play the game or win the prize.
All final decisions will rest with the Absolute Radio Production Team.
3. ENTRY PERIOD
Entries must be submitted during the following entry period:
Online Pre-registration: From 00:01 AM 09/10/2024 (the “Start Time”) to 11:00 AM 15/10/2024 (“End Time”).
On-air Competition: From 14/10/2024 – 18/10/2024 each morning a finalist will be brought to air during the Dave Berry Breakfast Show between 06:00 – 10:00. The on-air finalists will be given information of when the exact date timings will be ahead of being brought to air.
Entries received before the Start Time or after the End Time will be invalid.
Winner Announcement.
The winner announcements will take place on 18/10/24 during the Absolute Radio Dave Berry Breakfast Show.
4. ENTRY RESTRICTIONS
- Certain community project exclusions apply – see section 2.
- Open to UK residents aged 18 years or over on date of entry.
- One entry per person.
- Our employees (and their family members) or employees of any company involved in the Competition, including any Prize Provider, are not permitted to enter.
- If you or any other person at your household has won a prize valued at £500 or more on any Bauer brand in the past 6 months, you nor they are not eligible to enter or win this competition. The full list of Bauer Media brands can be found here: https://www.bauermedia.co.uk/brands
5. THE PRIZE
There will be 1 (one) winner of this competition only.
The prize package for one (1) Community Project will include a total value of £10,000 made up of the following:
· £5,000 Wickes In-Store Gift Card (Provided by Wickes)
· £5,000 Cash (Provided by Absolute Radio / Bauer)
Prize specific terms and conditions:
· The gift card included in this prize is only available to spend in Wickes stores across the UK.
· It is not possible to spend it online.
· Only one prize will be awarded during the competition period.
· If a person is selected at random duplicate times during the competition entry period, then another entry will be selected at random from all other entries.
· Use of a false name will result in disqualification.
· The Prize is non-transferable, non-refundable and there is no cash alternative. Wickes reserves the right to substitute the Prize with one of equal or greater value at any time.
· Any changes to the prize draw will be notified to entrants as soon as possible by Wickes.
· Entrants who sign up to the Wickes marketing can opt out at any time. All marketing content which is sent to entrants will have an opt-out link within the content.
· The Wickes In-Store Gift Card prize is provided by Wickes. Bauer is not responsible for any aspect of the Prize, including unsatisfactory quality or late delivery.
· Prizing may be sent by Wickes up to 28 days after the competition ends (after 18/10/2024).
Additional terms apply to this prize as set out by the Wickes Community Programme:
In 2021, Wickes launched the Community Programme, a dedicated product fund to support local initiatives in helping them maintain and renovate community areas. By participating in the Community Programme, you agree that the following terms shall apply.
1. The Community Programme is aimed at supporting organisations seeking help for improvement projects, these include schools, colleges, nurseries, youth groups, registered charities, community spaces, local recreational groups, hospices and hospitals, and animal wildlife rescue organisations.
2. The Community Programme is conducted by Wickes Building Supplies Limited, (Company Number 01840419) whose registered office is at Vision House, 19 Colonial Way, Watford, United Kingdom, WD24 4JL (“Wickes”).
3. Participating organisations shall not use the donated supplies for any of the following purposes: re-sale, as part of a raffle or lottery, personal or commercial reasons. Businesses and ‘for profit’ organisations are not eligible to participate in the Community Programme.
4. We reserve the right to cancel, amend, withdraw, terminate or temporarily suspend this promotion for any reason, including noncompliance with these terms and conditions.
5. Wickes and/or its suppliers shall provide the supplies in good faith and working order, however, we cannot guarantee that refunds and replacements will be provided.
6. Wickes shall not be held liable for any loss, or for any indirect, special, incidental, or consequential damages of any kind regardless of the form of action, whether in contract, tort (including negligence), strict product liability, or otherwise.
7. Nothing in these terms and conditions shall be construed as an attempt to limit either party’s liability for death or personal injury caused by that party’s negligence or for fraud, or for any liability that may not be limited or excluded by law
8. As part of the Community Programme, Wickes collects the following personal data: full name, email address and phone number. We may use your personal information in connection with the Community Programme to contact you in regards to public relations and marketing support, future donations and volunteering opportunities.
9. Wickes may seek to publicise the donation under the Community Project and may therefore request approval from you to use relevant intellectual property. Wickes shall collaborate with you to ensure all necessary consents are obtained from relevant individuals, including vulnerable people, prior to the use of any intellectual property.
10. These terms and conditions are between you and Wickes. No other person shall have any rights to enforce any of the terms.
11. The application and interpretation of these terms and conditions shall be governed by the law of England and Wales and the courts of England and Wales shall have exclusive jurisdiction in relation to any dispute concerning them.

OTHER CONDITIONS
1. DATA PROTECTION. Names, email addresses, and /or telephone numbers (which, for all SMS competitions, will be shared with our SMS provider) will be collected and used to process entries. Winner’s details may be given to a Prize Provider to arrange delivery of the prize. Your details may remain stored after the End Date but will not be used for marketing unless you have ticked an opt-in box on entry. For SMS entries you automatically consent to receive marketing. You may opt out at any time by texting the word STOP to the relevant text shortcode number. If you have opted in to receive marketing communications, then your details will be used in accordance with the information given when you ticked the opt-in box and gave your consent. 2. INTELLECTUAL PROPERTY AND CONSENTS. By entering this Competition, you are consenting to our use of your entry both to publicise this Competition, our radio station or any other radio station which we own or control. This means that we may use all names, images, descriptions, photographs video footage, and other information, which you have submitted on entry, in any media, without paying you any remuneration therefore and without any time restriction. You also agree that we may film, record or photograph you in connection with the competition and /or the Prize if applicable. We will own these films, recordings or photographs and we may use them publicly, including on the internet, for our radio broadcasts and/or for any promotional purposes. You will also have waived any moral rights or right to payment that you may have had.
3. MISCELLANEOUS.
- Entries which do not comply with these Terms or the General Competition Terms and Conditions will not be accepted and any entries may be disqualified if we have any reason to suspect that there is a breach of, or non-compliance with, these Terms.
- Where a competition mechanic involves the answering of questions, the correct answers to questions must match our answers to win (or be sufficiently close in our sole reasonable opinion) to be acceptable. In the event of any dispute about any answers given and whether they are correct, we reserve the right to amend what we deem a correct answer, however we are not obliged to, and our decision in either case is final and no correspondence will be entered into.
- We are not responsible if you fail to get through when you call / text to enter, or if you lose signal during a call.
- You are responsible for all costs of entry and where necessary, obtaining the bill payer’s permission. Please refer to your tariff with your network provider for information about charges you may incur for entry into our competitions via any SMS or phone call entry route.
- We accept no liability for network, technical or signal errors, issues or failures experienced by entrants when entering the competition or at any stage during the mechanic of the competition.
- Whilst on-air, you must not make any inappropriate, profane, indecent, harmful or offensive statements. If you do so we reserve the right to take you off-air immediately and disqualify you from the competition. You may be also disqualified from the competition at any time if you are incomprehensible, inaudible or if you appear to be driving, intoxicated or likely to offend listeners. Any prize already won may be withdrawn and re-awarded to another entrant.
- As far as it is lawful to do so we exclude our liability for any losses suffered in connection with the Competition or any element of the Prize.
We may cancel, end or suspend the Competition where we are required to do so in circumstances outside our control. We reserve the right to amend these Terms at any stage during the Competition if such amendment is necessary to facilitate the administration of the Competition.
